Can a place of employment send home an employee for a few hours because hear say to be a child sex offender ?

A place of employment sent home a person for a few hours at customers request so they can dine at place of establishment. They did not want to lose in come. Because of past hear say of history as a youth. Person is not on a level or on a list. Small town. They did not check just asked him to leave and come back later. He missed two hours of paid time. should this be acceptable?

No, you don’t send employes home just because of a rumor. That’s like firing someone because their gay. Which is totally wrong.

    This is ok…once. But you can’t keep doing this, and the employee could sue if indeed they are not on any sex offender list.

    I guess it would’nt hurt to do a background check on all employees.

    First, it’s a rumor, it’s not hearsay. Hearsay is specific to a legal proceeding.

    Second, if it’s at will employment, the employer can dismiss the person at any time for any reason. In fact, it’s in the employer’s best interest to not give a reason. The reason could be actionable, whereas just claiming it’s under terms of employment gives the employer more protection.
